This Privacy Policy (hereinafter referred to as the "Policy") regulates relations in the field of personal data protection of visitors to the website https://tviykrok.com.ua/ (hereinafter referred to as the "Website"), which belongs to the CHARITY ORGANIZATION  CHARITY FUND "TVIY KROK" (code 45091648, address: 61058, Ukraine, Kharkiv, Klochkivska St., 99A), registered in accordance with the current legislation of Ukraine (hereinafter referred to as the "Fund").

1. GENERAL PROVISIONS.

1.1. In this Policy, the terms are used in the following sense:
• personal data base - a named set of organized personal data in electronic form and/or in the form of personal data files;
• consent of the subject of personal data - a voluntary expression of the individual's will (provided that he is informed) regarding the granting of permission for the processing of his personal data in accordance with the formulated purpose of their processing, expressed in a form that makes it possible to conclude that consent has been given;
• processing of personal data - any action or set of actions, such as collection, registration, accumulation, storage, adaptation, change, renewal, use and distribution (distribution, implementation, transfer), depersonalization, destruction of personal data, including using information (automated ) systems;
• personal data  - information or a set of information about a natural person who is identified or can be specifically identified;

  • subject of personal data  - a natural person whose personal data is processed;
  • third party  - any person, with the exception of the subject of personal data, the owner or administrator of personal data;

all other terms in the Policy are used in the meaning defined by the current legislation of Ukraine, including international legal acts ratified in Ukraine.

1.2. This Policy is designed to inform personal data subjects about the procedure for processing their personal data when visiting/using the Website, as well as to ensure the protection of their personal data during such processing.

1.3. This Policy, as well as the Fund's activities related to the collection, processing, storage and other lawful actions regarding personal data, are regulated by:

  • the Constitution of Ukraine;
  • by the Law of Ukraine "On Protection of Personal Data" dated June 1, 2010 No. 2287-VI;
  • other current normative legal acts of Ukraine, which regulate the issue of personal data protection;

• international legal acts ratified in Ukraine.

The law (including international), national and international legal acts governing the protection of personal data of residents of such countries also applies to legal relations that arise in the Fund in connection with the processing of personal data of residents of foreign jurisdictions.

1.4. The owner of personal data processed in connection with visiting/using the Website options is the Foundation. The Foundation has the right to fully or partially entrust the processing of personal data to third parties on the basis of a contract concluded in accordance with the requirements of current legislation.

1.5. A natural person is a subject of personal data according to this Policy, if he is a visitor to the Website, including if she uses any of the options available on the Website.

1.6. The fund guarantees that:

  • adheres to good practice and regulatory requirements for the protection of personal data;
  • protects the rights of personal data subjects;
  • prevents the risk of violation of the security of personal data processing.

1.7. The purpose of processing personal data  obtained during the functioning of the Website is the implementation of the Foundation's statutory activities.

1.8. Posting this Policy using the link specified in clause 4.1. of this Policy, is a notification to the subjects of personal data about the Owner, the composition and content of personal data collected in connection with visiting/using the Website, about the rights of such subjects, the purpose of collecting their personal data and third parties who such personal data may be transferred.

2. PERSONAL DATA PROCESSING. 

2.1. The Foundation may collect and process the following information about you:
• Information you provide to the Foundation: this is information about you that you provide by: using the Website and Website options, signing up to receive email updates, providing charitable assistance (donations ) using the Website options, communication with the Fund through the options available on the Website, etc.
• Information about you collected by the Website and other systems: 1) if you visit the Website, third parties may collect certain information about you and your visit, such as the type and version of your browser, as well as the pages on the Website that you visit, the Internet Protocol (IP) address; 2) The website may also download cookies to your device; 3) if you contact the employees of the Fund using the Website or other means of electronic communication.
• Information that third parties collect about you on the Website through actions taken:  this is information about you that you provide to third parties (for example, Facebook, Google, Twitter) using the social media sharing options available on the Website , when moving from one page to another or by viewing materials that have links (opening) to other platforms (websites).

2.2. How the Foundation processes your personal data depends on how you use and interact with the Website. Some of the information may be provided directly by you while using the Website or in another way; other information may be collected and processed by the Fund independently using automated technologies used on the Website.

2.3. Legal grounds for data processing : when visiting the Website, the Fund processes your personal data, if 1) the Fund has received your consent to such processing, 2) your personal data is necessary for the Fund to conclude and execute a transaction with you or to carry out activities preceding the conclusion of a transaction . In some cases, the Fund may have a legal obligation to process your personal data or will process your personal data to establish, exercise or defend legal claims.

2.4. Automated processing mechanisms:  The Foundation and third parties may use automated information processing technologies to process information in some sections of the Website. The Foundation uses cookies to store content and settings, which allows the Foundation to process standard information that your browser sends to certain websites you visit, such as your IP address, browser type and language, and the site you came from , the pages you visit and the links you click on the Website. The availability of such technical information helps the Foundation to improve the Website.

2.5. The Fund may use your personal data only for the purpose and for the purposes specified by this Policy and current legislation, in particular (but not limited to), 1) for the purpose of processing your request (appeal) to the Fund made using the Website, 2) with in order to ensure that you provide charitable assistance (donations) using the options available on the Website, 3) in order to implement other statutory purposes of the Fund in the manner determined by current legislation.

2.6. The Foundation may accumulate personal data processed during your visit/use of the Website, including by entering this data into a personal database. The storage of your personal data is carried out in compliance with the requirements of current legislation in the field of personal data.

2.7. The distribution of your personal data is carried out exclusively with your consent or in the cases specified by this Policy and current legislation.

2.8. Your personal data are subject to deletion or destruction in the event of:
• expiration of the 2-year storage period or another period determined by current legislation;
• termination of legal relations between the subject of personal data and the Fund, if otherwise provided by law;
• in other cases determined by current legislation in the field of personal data protection.

2.9. The Foundation does not process personal data on racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, criminal convictions, as well as data related to health, sexual life, biometric or genetic data, except for the cases specified by law.

3. RIGHTS OF PERSONAL DATA SUBJECTS. 

3.1. When visiting/using the Website, you have the right to:
• receive from the Fund information not specified in this Policy regarding the processing, terms of providing access to your personal data, or give an appropriate mandate to receive this information by persons authorized by you, except for cases specified by law ;
• for free access to your personal data;
• receive a response to the request regarding the processing of your personal data in the manner and within the time limit determined by the current legislation;
• make a reasoned claim with an objection to the processing of your personal data, or regarding the change or destruction of your personal data, if such data is processed illegally or is unreliable;
• to protect your personal data from illegal processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision of data, as well as protection from providing information that is unreliable or dishonors the honor, dignity and business reputation of a physical person individuals;
• withdraw your consent to the processing of personal data;

and also exercise other rights defined by current legislation in the field of personal data protection.

3.2. You have the right to address issues related to the collection, use, storage and other processing of your personal data to the Human Rights Commissioner of the Verkhovna Rada of Ukraine, who can be contacted via the e-mail address [email protected].   • The fund does not process requests for the delivery of aid to the military.
  • The fund does not consider requests that were spoken to the hotline, sent in personal messages to the fund team, left in comments or messages of the fund and its representatives.
